Penalties for Texas Criminal Convictions

Punishments under Texas law vary widely depending upon the type of offense committed. Generally speaking, Texas crimes are classified either as misdemeanors or felonies.
There are five categories of felony offenses:
- Capital felonies: for offenders under the age of 18, a capital offense requires a life sentence upon conviction, while a life sentence without parole is mandatory for anyone 18 or older, and the state can seek the death penalty in these cases;
- Felonies of the first degree: fine not to exceed $10,000 and between 5 years and 99 years imprisonment;
- Felonies of the second degree: fine not to exceed $10,000 and between 2 and 20 years imprisonment;
- Felonies of the third degree: fine not to exceed $10,000 and between 2 and 10 years imprisonment; and
- State jail felonies: fine not to exceed $10,000 and jail term of between 180 days and 2 years.
There are three categories of misdemeanor offenses:
- Class A misdemeanors: fine not to exceed $4,000, and/or confinement in jail for no more than one year;
- Class B misdemeanors: fine not to exceed $2,000, and/or confinement in jail for no more than 180 days; and
- Class C misdemeanors: fine not to exceed $500.
